  2. EASEMENT AGREEMENT 
  3.  
  4. ______________________________, referred to as OWNER, and
  5. ______________________________, referred to as GRANTEE,  agree: 
  6.  
  7. OWNER is the owner in fee simple of the following described real 
  8. estate:

  12. In consideration of $ _____________ ( __________________________
  13. & _______/100 dollars) paid by GRANTEE, the  OWNER grants to
  14. GRANTEE an exclusive easement to excavate and  remove sand and
  15. gravel, which shall include all necessary and  ancillary rights
  16. thereto including the right of ingress and  egress, the right to
  17. erect outbuildings or to store equipment  thereon for a period of
  18. _____________ years. However, at the expiration of  the term of
  19. this lease, GRANTEE shall remove all such equipment  and
  20. outbuildings. Further, GRANTEE shall at the time of  termination
  21. of this agreement slope all banks which may be  hazardous.

  23. GRANTEE shall promptly begin excavation operations and shall 
  24. diligently utilize the property for the purpose of excavating 
  25. sand and gavel and shall maintain continuous and regular 
  26. excavations. 
  27.  
  28. GRANTEE shall pay $_______________ ( _________________________
  29. & _______/100 dollars) per _____________ for all sand or  gravel
  30. removed to OWNER with settlement and payment due no later  than
  31. the fifth of each month for the previous month. GRANTEE  shall
  32. keep complete and accurate records of the amounts of sand  and
  33. gravel removed from the property. Such records shall be  subject
  34. to the right of OWNER to inspect the same at all  reasonable
  35. times.

  37. GRANTEE shall construct fences around any sand and gravel pits 
  38. sufficient and as used in good practice. GRANTEE shall at all 
  39. times maintain insurance with minimum limits of

  43. OWNER may use any portions of the property not being excavated or 
  44. reasonably required by GRANTEE.

  46. The grant of easement herein shall bind the heirs and assigns of

  48. without the consent of OWNER. The rights herein shall be 
  49. specifically enforceable.
